Terms and conditions of sale

1. General provisions

1.1 These general terms and conditions of sale (GTC) govern the relationship between, on the one hand, Chocolats Pascoët Sarl with all its subsidiaries, shareholders and holdings, in Switzerland and abroad (hereinafter jointly referred to as the ‘Pascoët Group’) and, on the other hand, its online shop customers (hereinafter referred to as ‘customers’).

1.2 These GTC are an integral part of every contract concluded between the Pascoët Group and a customer. They apply to the ordering and delivery of the various products and offers available on the Pascoët Group’s website and online shop.

1.3 The Pascoët Group reserves the right to amend these GTC at any time.

2. Conclusion of contract

2.1 The customer’s order is placed online. Upon receipt of the order, the Pascoët Group will send an order confirmation to the customer.

2.2 The contract is concluded when Groupe Pascoët sends the customer an order confirmation by email. Customers who confirm their basket, finalise their order and pay the total amount for the products ordered online accept these GTC.

3. Changes to the order

3.1 After placing an order online, the customer acknowledges that they can no longer make any changes to their order.

4. Price

4.1 Product prices are those indicated on the day the customer places their order and remain firm and final until the order is confirmed by Groupe Pascoët. They are displayed on the Groupe Pascoët online store in CHF (Swiss francs) and include VAT at the current rate.

5. Payment terms

5.1 Unless otherwise agreed in advance, payment shall be made in advance. Payment must be made online by credit card or PayPal to confirm the order.

5.2 If the customer wishes to pay by invoice or on behalf of a company, they must contact the Pascoët Group directly at commande@pascoet.com.

5.3 In all cases, the goods ordered will only be delivered after payment has been received.

6. Postage costs

6.1 The shipping costs applicable to the order are payable by the customer and depend on the geographical area of delivery and the weight of the order.

6.2 For shipments outside Switzerland, the customer shall be responsible for any customs and import duties.

6.3 Shipping costs are calculated individually based on the destination (delivery zone), packaging and weight. They are displayed before the order is finalised.

7. Delivery terms

7.1 Delivery of ordered items is carried out worldwide and is at the customer’s risk and expense.

7.2 For shipments to areas with high temperatures or during warmer weather periods, given the nature of the Pascoët Group’s chocolate products, suitable packaging will be used and invoiced to the customer, or the Pascoët Group reserves the right to refuse delivery.

7.3 The customer is responsible for providing complete and accurate delivery details necessary for the correct delivery of the parcel.

7.4 The Pascoët Group declines all responsibility in the event of delivery delays beyond its control, e.g. bad weather conditions, traffic jams, customs delays, impossible delivery, force majeure. Under no circumstances can the Pascoët Group be held responsible for damage that may occur to products as a result of the package being opened during transit.

7.5 If delivery of the order could not be made or was made impossible due to the customer (recipient absent at the time of delivery, customs issues, incorrect address, refusal of goods, etc.), the Pascoët Group cannot be held liable, reserves the right to cancel the contract, and the delivery and/or return costs shall remain the responsibility of the customer.

7.6 If the order cannot be delivered or delivery is made impossible by the customer (recipient absent at the time of delivery, customs issues, incorrect address, refusal of goods, etc.), the customer acknowledges that the respective delivery and/or return costs will be deducted from the amount already paid when placing the order. If the customer wishes to resend an order that has been returned to the Pascoët Group due to the customer’s actions (as described above), the new delivery costs will be at their expense.

7.7 The estimated delivery times are provided for information purposes only. The Pascoët Group cannot be held liable for delays in delivery beyond its control, for example in cases of force majeure, transport strikes, delays caused by a pandemic, natural disasters, terrorist acts, wars, problems affecting suppliers and transport, bad weather conditions, unusual and unexpected delays by customs authorities, and these situations do not entitle the customer to withdraw from the sales contract or claim compensation. If such circumstances last for more than 40 days, the contract may be terminated by written notice from either party, without compensation or indemnity.

7.8 The customer acknowledges that delivery times are longer during holidays (Valentine’s Day, Mother’s Day, Easter, and Christmas) and plans their orders accordingly.

8. Availability

8.1 Pascoët Group chocolates are produced using traditional methods and may be subject to temporary stock shortages. The Pascoët Group online shop accepts no responsibility in such circumstances but will do its utmost to notify the customer by email and fulfil the order within a reasonable time frame. In the event of temporary unavailability, the Pascoët Group online shop is authorised to make partial deliveries.

9. Complaints

9.1 The customer or recipient of the order undertakes to check the quantities and condition of the goods upon receipt. Any complaints regarding quality or quantity must be reported to the Pascoët Group by email to commande@pascoet.com immediately, or within a maximum of 24 hours after delivery. After this period, the delivery will be considered accepted and no complaints will be taken into account.

10. Returns, exchanges and right of withdrawal

10.1 The Pascoët Group does not accept returns. The return or exchange of products delivered complete and intact is excluded.

10.2 Given that all products sold on the Pascoët Group’s online shop are likely to deteriorate or expire quickly, any right of withdrawal for the customer is excluded.

11. Data protection and copyright

11.1 Customer data shall not be sold, rented, loaned or exchanged to third parties under any circumstances.

11.2 If the customer subscribes to the Pascoët Group newsletter, their email address will only be used for this purpose until they unsubscribe from the newsletter.

11.3 Unless otherwise stated, all images and content found on the Pascoët Group website belong to the Pascoët Group and may not be used, modified or sold, in whole or in part, without its written consent.

12. Applicable law and place of jurisdiction

12.1 These GTC are governed exclusively by Swiss law.

12.2 The exclusive place of jurisdiction is Geneva for any dispute or disagreement concerning the Pascoët Group and its contractual relations with its customers, subject to appeals before the Swiss Federal Court.
